Your business keeps growing. Your registration needs attention, too.

For U.S. registrations based on use in commerce or a foreign registration, the usual schedule is:
| Filing window | Required filing |
|---|---|
| Between years 5 and 6 after registration | Section 8 declaration of use and/or excusable nonuse |
| Between years 9 and 10 | Combined Section 8 declaration and Section 9 renewal application |
| Every 10 years afterward | Subsequent combined Section 8 and Section 9 filings |
The first filing is a maintenance requirement—not a ten-year renewal. Madrid Protocol registrations follow different requirements. See the USPTO’s maintenance guidance.
